Plain-language summary. This is not a replacement for the terms below, but it is what they mean. You are renting access to a service, not buying software. We never take custody of your money — you pay us once per subscription, directly, like paying a shop. We can never lock your mining hardware; only you can, and only you can unlock it. Chip optimization is switched off until you turn it on, and it only asks your existing firmware to change its power target within limits that firmware itself declares safe. Mining is volatile and hardware fails; we do not guarantee profit or uptime.

1. Who we are

These Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and HashOps ("HashOps", "we", "us"), operator of the service at hashops.dev (the "Service"). HashOps is a digital service and is contactable at the addresses set out in clause 23.

By creating an account, installing the Agent, or using the Service in any way, you confirm that you have read, understood and accept these Terms. If you do not accept them, do not use the Service.

If you are entering into these Terms on behalf of a company or other organisation, you confirm you have authority to bind that organisation, and "you" means that organisation.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

2. Definitions

  • Agent — the HashOps software component you install on a mining device so it can report telemetry and apply settings you have authorised.
  • Device — a single ASIC mining machine registered to your account. Subscriptions are per Device.
  • Firmware — the operating software already running on your Device, whether the manufacturer's stock firmware or a third-party firmware such as Braiins OS+, LuxOS or VNish. HashOps is not firmware and does not replace it.
  • Network Optimization — routing your Device's mining traffic through the HashOps managed Stratum proxy.
  • Chip Optimization — instructing your Device's existing Firmware, through that Firmware's own interface, to move its power target.
  • Subscription Term — the period for which you have paid for a given Device.

3. What the Service is — and is not

HashOps is a fleet management, monitoring and optimization layer for ASIC mining devices. It provides an account dashboard, telemetry collection, a managed Stratum proxy, optional optimization modules, owner-controlled device locking, and subscription billing.

The Service is expressly not:

  • Not firmware. HashOps does not replace your Device's operating software and does not write to voltage or frequency registers. Where Chip Optimization is enabled, HashOps sends requests to the Firmware you already run, through interfaces that Firmware publishes, and that Firmware decides how to act on them.
  • Not a mining pool. You choose your own pool and your payouts go directly to you. HashOps never receives, holds, routes or has any claim to your mining rewards.
  • Not a wallet, exchange, custodian or money transmitter. See clause 12.
  • Not an investment, financial or tax service. Nothing in the Service or its documentation is financial advice.
  • Not a repair, warranty or insurance service for your hardware.

Third-party firmware vendors are independent of HashOps. We are not affiliated with, endorsed by, or acting as agent for Braiins, Luxor, VNish or any hardware manufacturer. Their names are used only to identify compatibility. Your relationship with those vendors, including their own licence terms and warranties, is yours alone — see clause 10.

4. Accounts and security

You are responsible for the accuracy of your registration details, for keeping your password confidential, and for all activity that occurs under your account.

We strongly recommend enabling two-factor authentication, which the Service offers free of charge. If you enable it, you are responsible for storing your backup codes safely. If you lose both your authenticator device and your backup codes, we may be unable to restore access to your account.

You must notify us promptly at security@hashops.dev if you believe your account has been accessed without authorisation.

You may not share, sell, rent or transfer your account credentials, or allow anyone else to use your account.

5. Licence, not ownership

A subscription buys access for a period of time. It does not buy the software, and it does not transfer any ownership.

5.1 What we grant you

Subject to your compliance with these Terms and to payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence, for the Subscription Term only, to:

  • access and use the Service for your own internal business or personal mining operations; and
  • install and run one copy of the Agent on each Device covered by a paid subscription.

5.2 What we do not grant you

This licence transfers no ownership of any kind. All rights not expressly granted above are reserved. In particular, you may not:

  • copy, modify, adapt, translate or create derivative works of the Service or the Agent, except as compelled by law that cannot be excluded by contract;
  • reverse engineer, decompile or disassemble any part of the Service or Agent, or attempt to derive its source code, algorithms or underlying ideas, again except where such a restriction is unenforceable under applicable law;
  • rent, lease, lend, sell, sublicense, distribute, host or otherwise make the Service or Agent available to any third party, or operate it as a service bureau — except under a separate written reseller or white-label agreement with us;
  • remove, obscure or alter any proprietary notice, licence text or attribution;
  • use the Service to build, train or inform a competing product; or
  • circumvent or attempt to circumvent any licensing, metering, rate-limiting or access control.

5.3 The licence ends when the subscription ends

When a Subscription Term expires or is terminated, the licence for that Device ends immediately. The Agent will stop applying optimization and the Device reverts to operating on its own Firmware and configuration. You may uninstall the Agent at any time (see clause 9.4).

5.4 "Lifetime" plans

A plan described as "lifetime" grants a licence for the working life of the specific Device it was purchased for. To be clear about what that does and does not mean:

  • It is tied to one Device and is not transferable to a replacement or different machine.
  • It ends if that Device is permanently retired, destroyed, or removed from your account.
  • It cannot outlast the Service itself. If HashOps ceases operating the Service, the licence ends with it. See clause 20.4 for what happens in that case.

6. Intellectual property

The Service, the Agent, the HashOps proxy, the dashboard, all associated source code, designs, interfaces, documentation, the HashOps name and logo, and all improvements to any of them, are and remain the exclusive property of HashOps and its licensors, and are protected by copyright and other intellectual property laws.

If you send us feedback, suggestions or ideas about the Service, you grant us a perpetual, worldwide, royalty-free licence to use them without obligation or compensation to you. We will not treat feedback as your confidential information unless you tell us in writing beforehand and we agree.

Your data remains yours. Telemetry, configuration and account data you generate through the Service belong to you. Clause 14 sets out what we do with them.

The Service may include third-party open-source components, each governed by its own licence. Those licences prevail over this clause to the extent they conflict, and nothing here restricts rights granted to you under them.

7. Plans, pricing and payment

7.1 How payment works

Subscriptions are paid in USDC on the Stellar network. When you create an invoice, the Service issues a unique payment memo. You send the exact amount to the address shown, including that memo. Payment is matched automatically, usually within a minute, and the subscription activates.

7.2 Your responsibilities when paying

Blockchain payments cannot be reversed by us or by anyone else. Please read this clause carefully.

  • You must include the exact memo. A payment without the correct memo cannot be automatically matched to your account.
  • You must send the correct asset (USDC) on the correct network (Stellar) to the correct address. Funds sent as a different asset, on a different blockchain, or to a different address may be permanently and irrecoverably lost. We have no visibility into other networks and no ability to recover such transfers.
  • You must send at least the invoiced amount. Underpayments do not activate a subscription.
  • Network fees are yours to bear.

If you make a payment error, contact us at billing@hashops.dev. We will make reasonable efforts to help where a transaction is genuinely identifiable and recoverable, but we cannot promise recovery and are not liable for losses caused by an incorrect transfer.

7.3 Taxes

Prices are exclusive of taxes. You are responsible for determining and paying any taxes, duties or levies arising from your purchase and from your mining activity, and for your own accounting treatment of crypto-asset payments. The Service can export invoice records including on-chain transaction hashes for your bookkeeping; those records state amounts in USDC and do not convert to any fiat currency, because the correct conversion depends on your jurisdiction and accounting method.

7.4 No automatic renewal

Subscriptions do not auto-renew and we do not store payment credentials. Each renewal is a new, deliberate payment by you. If a Subscription Term ends without renewal, the Device moves to an expired state as described in clause 10.4.

7.5 Price changes

We may change prices for future purchases. Changes never affect a Subscription Term you have already paid for.

8. Refunds and cancellation

You may stop using the Service at any time. Because subscriptions are prepaid, one-time, non-recurring payments, fees are generally non-refundable and stopping use does not entitle you to a refund of the remaining term.

We will consider a refund, at our discretion, where the Service was materially unavailable for a prolonged period due to our fault, or where a duplicate or clearly erroneous payment was made and is identifiable on-chain.

Nothing in this clause limits any non-waivable statutory right you may have as a consumer under the law of your country of residence, including any statutory cooling-off or withdrawal right.

9. The Agent software

9.1 What it requires

The Agent requires a Device with shell access, Linux, Python 3 and systemd. It cannot be installed on locked-down stock manufacturer firmware that provides no shell access; on such Devices the installer stops with a clear message rather than partially installing.

9.2 What it does

  • Reads telemetry from your Device's local mining interface (hashrate, temperatures, fan speeds, accepted and rejected shares, and per-board chip counts where the Firmware reports them).
  • Sends that telemetry to your HashOps account over an authenticated connection.
  • Applies only the states and settings you have authorised through your dashboard.
  • Backs up your original mining configuration before modifying it, so the change can be undone.

9.3 What it does not do

The Agent does not flash, reflash or modify firmware images. It does not write to voltage or frequency registers. It contains no remote wipe, no self-deleting code, and no capability to render a Device permanently inoperable. Every state it can apply is reversible.

9.4 Removing it

You may uninstall at any time by choosing "Revert" in the dashboard, which restores your backed-up configuration and disables the Agent's service, or by removing the Agent manually from the Device. Neither requires our permission or cooperation.

9.5 Your responsibility

You confirm that you own the Devices you register, or that you have the owner's authorisation to install software on them and to change their operating settings. You are responsible for the physical environment your Devices run in, including power quality, cooling, ventilation and ambient temperature.

10. Optimization modules

The Service offers two independent modules per Device. Each is a separate choice and each can be switched on or off at any time.

10.1 Network Optimization

Routes your Device's mining traffic through our managed Stratum proxy to reduce latency and stale or rejected shares. It does not alter how your hardware operates. It is available on every Firmware, including locked stock firmware.

You continue to choose your own pool. We do not change your payout address and have no access to your mining rewards. If our proxy becomes unavailable, your Device is configured to continue mining to your chosen pool.

10.2 Chip Optimization

This module is switched off by default. Nothing changes about how your hardware runs unless you deliberately enable it, per Device.

When enabled, HashOps calculates a power target according to the objective you choose — Longevity (default; deliberately below nominal to reduce thermal and electrical stress), Efficiency (best energy per terahash), or Economic (highest profit given the electricity price and payout figures you supply) — and asks your Device's existing Firmware to move toward it, using that Firmware's own published interface.

The following safeguards are built in and operate automatically:

  • Requested targets are clamped to the minimum and maximum the Firmware itself declares.
  • Changes move in steps of no more than 10% of the current target.
  • No more than one change per hour, so the Firmware's own tuner can settle.
  • Power is reduced automatically if temperature exceeds the limit you set, and further reduced above 85 °C.
  • An 80 °C ceiling applies that no setting of yours can raise.
  • The Firmware default is restored automatically if hashrate falls significantly after a change.
  • A Device whose Firmware has not reported tuning capability is never sent an instruction.

10.3 Risks you accept when enabling Chip Optimization

Notwithstanding those safeguards, you acknowledge and accept that:

  • Mining hardware operates under continuous thermal and electrical stress and can fail at any time, with or without HashOps. Components degrade with use.
  • We do not control your Firmware. It decides how to act on a requested target, and its behaviour, accuracy and safety limits are the vendor's responsibility, not ours.
  • We do not control ambient temperature, airflow, power supply quality, electrical stability, or the prior condition or wear of your hardware.
  • Changing operating parameters through an external interface may affect your hardware warranty or your firmware vendor's terms. Checking that is your responsibility before enabling this module.
  • No objective, including "Longevity", is a guarantee of extended hardware life, and no objective, including "Economic", is a guarantee or projection of profit.

If you are not willing to accept these risks, leave Chip Optimization switched off. Network Optimization, telemetry, alerting and device locking all remain fully available.

10.4 Expiry

If a subscription lapses, the Device moves to an expired state: optimization stops and the Device falls back to its own configuration and continues mining directly to your pool. An expired subscription never locks, disables or stops a Device. Renewing restores service.

11. Device lock — an anti-theft tool you control

HashOps cannot lock your hardware. Only you can, and only you can unlock it. We will never use locking as leverage for payment.

The Service includes an optional lock feature so that if a Device is stolen or physically accessed without your permission, you can render it useless to whoever holds it. It works like the remote lock on a phone or laptop.

  • Lock and unlock are triggered only from your own authenticated dashboard session, on a Device registered to your account. The system verifies ownership on every such request.
  • HashOps does not initiate locks. There is no mechanism in the Service by which we lock a customer Device, and non-payment routes to the separate expired state described in clause 10.4 — never to a lock.
  • You can unlock at any time from your dashboard, or with a rescue code you generate yourself, which works directly against the Device even without connectivity to us.
  • Locking stops the mining service and swaps a configuration file. It is fully reversible and causes no permanent change to the hardware.

You must only lock Devices you own or are authorised to control. Using this feature against hardware belonging to someone else may be unlawful and is a serious breach of these Terms.

12. We never hold your money

HashOps is not a custodian. We receive one-time payments for a service, exactly as a shop receives payment for a sale.

  • There is no user wallet, no stored balance and no withdrawal function in the Service.
  • We never hold, transmit, exchange or control crypto-assets on your behalf.
  • Your mining rewards go directly from your pool to an address you control. We never touch them, cannot redirect them, and have no claim over them.
  • We cannot move funds "on your behalf" to anywhere, because no such capability exists in the system.

You remain solely responsible for the security of your own wallets, keys and pool payout configuration.

13. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose, or in breach of any sanctions, export control or anti-money-laundering law that applies to you;
  • register or control Devices you do not own and are not authorised to manage;
  • use mining hardware or electricity obtained unlawfully, or operate in breach of an agreement with a landlord, hosting provider or utility;
  • attempt to gain unauthorised access to the Service, other customers' accounts or data, or our infrastructure;
  • probe, scan, penetration-test, overload or interfere with the Service without our prior written permission;
  • introduce malware, or use the Service to attack any third party;
  • evade rate limits or usage controls, or use automated means to access the Service other than through the interfaces we provide; or
  • misrepresent your identity or affiliation.

You are responsible for complying with all laws applying to cryptocurrency mining where you operate, including registration, energy, environmental, tax and reporting obligations.

14. Data and privacy

14.1 What we collect

  • Account data — username, optional email address, hashed password, and (if you enable it) two-factor authentication secrets and hashed backup codes.
  • Device data — device names and identifiers you choose, and telemetry: hashrate, temperatures, fan speeds, power draw, accepted and rejected shares, and per-board chip counts where reported.
  • Operational data — configuration you set, tuning decisions and their reasons, invoice records and on-chain transaction references, security events such as failed logins and rescue-code attempts (including source IP address).

We do not collect your wallet private keys, your pool credentials or your payout addresses, because the Service has no need for them and no field to store them.

14.2 How we use it

To operate, secure and support the Service; to compute optimization decisions; to detect faults and send you alerts; to process subscriptions; and to comply with legal obligations. We do not sell your data.

14.3 Sharing

We share data only with infrastructure providers strictly necessary to run the Service (hosting, network protection, and email delivery where you have enabled email notifications), and where required by valid legal process. Blockchain payment data is inherently public on the Stellar network; that is a property of the network, not a disclosure by us.

14.4 Retention

Account and billing records are retained while your account is active and afterwards for as long as needed for legal, tax and accounting purposes. Telemetry is retained for operational and trend analysis. You may request deletion of your account and associated personal data by contacting privacy@hashops.dev; we will comply subject to records we are legally required to keep.

14.5 Your rights

Depending on where you live, you may have rights to access, correct, export, restrict or delete your personal data, and to object to certain processing. Contact privacy@hashops.dev to exercise them.

14.6 Security

We apply measures including password hashing, optional two-factor authentication, encrypted transport, server-side revocable sessions, login rate limiting and lockout, and audit logging of sensitive actions. No system is perfectly secure, and we cannot guarantee that unauthorised access will never occur.

15. Beta and pre-release features

We may make features available that are marked beta, alpha, preview or experimental. These are provided as-is, without any warranty, may be unstable or incomplete, may change or be withdrawn at any time without notice, and are excluded from any availability commitment. Do not rely on a beta feature for a critical operation. Access to beta features is granted at our discretion and may be revoked at any time.

16. Availability and support

We aim to keep the Service available continuously, but we do not commit to a specific uptime level and offer no service level agreement unless we have signed a separate written agreement with you that says otherwise.

The Service may be unavailable during maintenance, or because of failures in infrastructure, networks or third-party providers outside our control.

Support is provided on a best-efforts basis via hello@hashops.dev during reasonable business hours. We do not currently offer 24/7 support. The Service includes automated alerting that notifies you of offline devices, excessive temperatures and hashboard faults without human involvement; those alerts are observations, and do not constitute a commitment that anyone is responding to them.

17. Disclaimers

To the fullest extent permitted by applicable law, the Service and the Agent are provided "as is" and "as available", and we disclaim all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the above, we do not warrant that:

  • use of the Service will increase your hashrate, efficiency, revenue or profit;
  • any objective, including "Longevity", will extend the life of any hardware;
  • the Service will be uninterrupted, timely, error-free or free of harmful components;
  • telemetry, calculations, recommendations or reports will be accurate or complete; or
  • defects will be corrected.

Cryptocurrency mining profitability depends on network difficulty, asset prices, pool performance, electricity cost and hardware condition — all outside our control. Any figure, projection, optimization objective or pilot metric presented by the Service is an estimate based on data available to it, including figures you supply, and is not a promise of any outcome.

Some jurisdictions do not allow the exclusion of certain warranties. In those places, the exclusions above apply only to the extent permitted, and you may have rights that these Terms cannot remove.

18. Limitation of liability

To the fullest extent permitted by applicable law:

  • we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost mining revenue, lost opportunity, loss of data, or business interruption, however caused and under any theory of liability, even if we were advised such damages were possible;
  • our total aggregate liability arising out of or relating to these Terms or the Service, for all claims combined, will not exceed the total amount you actually paid us for the affected Device in the twelve (12) months before the event giving rise to the claim, or 100 USDC, whichever is greater.

These limits apply to the maximum extent permitted by law. Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited — including non-waivable consumer rights in your jurisdiction.

You acknowledge that the pricing of the Service reflects this allocation of risk, and that we would not provide the Service on these terms without it.

19. Indemnity

You agree to indemnify and hold harmless HashOps, its officers, employees and contractors from any claim, demand, loss, liability or expense (including reasonable legal fees) arising from: your use of the Service; your breach of these Terms; your violation of any law; your operation of mining hardware; or any claim that you registered, locked, modified or controlled a Device you were not authorised to control.

20. Suspension and termination

20.1 By you

You may stop using the Service and remove the Agent at any time, without needing our involvement. Contact hello@hashops.dev to have your account closed.

20.2 By us

We may suspend or terminate your access, with notice where reasonably practicable, if you materially breach these Terms, if your use threatens the security, integrity or lawful operation of the Service or other customers, or if required by law.

20.3 Effect

On termination, your licence ends and the Agent stops applying optimization. Termination never locks your hardware. Your Devices continue operating on their own Firmware and configuration, mining to your chosen pool. You may still remove the Agent yourself. Clauses that by their nature should survive — including 6, 12, 17, 18, 19 and 22 — survive termination.

20.4 If we discontinue the Service

If we decide to discontinue the Service entirely, we will give at least sixty (60) days' notice to the email address on your account where you have provided one, and via the dashboard. During that period you will be able to export your data. We will offer a pro-rata refund of any unused portion of a fixed-term subscription. For "lifetime" plans, we will offer a refund calculated on a fair and reasonable basis having regard to the time already served, which we will publish alongside the discontinuation notice. In all cases, Devices continue mining on their own Firmware after the Service ends.

21. Changes to these terms

We may update these Terms. For material changes we will give at least thirty (30) days' notice by email where you have provided an address, and by notice in the dashboard, before they take effect. Continuing to use the Service after that date means you accept the revised Terms. If you do not accept them, stop using the Service before the effective date; where a material change is genuinely detrimental to you, you may request a pro-rata refund of the unused portion of your current fixed-term subscription.

Every version is dated, and the version in force is always published on this page.

22. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which HashOps is established, without regard to conflict-of-law rules, and excluding the United Nations Convention on Contracts for the International Sale of Goods. The competent courts of that jurisdiction have exclusive jurisdiction, except that if you are a consumer, you retain the protection of mandatory laws and the right to bring proceedings in the courts of your country of residence where local law gives you that right.

Before starting formal proceedings, we ask that you contact us so we can try to resolve the matter directly. Most issues are resolved this way.

If any provision of these Terms is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with any documents they reference, are the entire agreement between us regarding the Service. You may not assign these Terms without our written consent; we may assign them to a successor in connection with a merger, acquisition or sale of assets, on notice to you.

Resumen en lenguaje sencillo. No sustituye a los términos de abajo, pero es lo que significan. Estás alquilando acceso a un servicio, no comprando software. Nunca custodiamos tu dinero: nos pagas una vez por suscripción, directamente, como se le paga a una tienda. Nunca podemos bloquear tu equipo de minería; solo tú puedes, y solo tú puedes desbloquearlo. La optimización de chip está apagada hasta que tú la enciendas, y solo le pide a tu firmware actual que cambie su objetivo de potencia dentro de los límites que ese mismo firmware declara seguros. La minería es volátil y el hardware falla; no garantizamos ganancias ni disponibilidad.

1. Quiénes somos

Estos Términos del Servicio (los "Términos") constituyen un acuerdo vinculante entre tú ("tú", el "Cliente") y HashOps ("HashOps", "nosotros"), operador del servicio en hashops.dev (el "Servicio"). HashOps es un servicio digital y puede ser contactado en las direcciones indicadas en la cláusula 23.

Al crear una cuenta, instalar el Agente o usar el Servicio de cualquier forma, confirmas que has leído, entendido y aceptas estos Términos. Si no los aceptas, no uses el Servicio.

Si aceptas estos Términos en nombre de una empresa u organización, confirmas que tienes autoridad para obligarla, y "tú" se refiere a esa organización.

2. Definiciones

  • Agente — el componente de software de HashOps que instalas en un equipo de minería para que reporte telemetría y aplique los ajustes que tú hayas autorizado.
  • Equipo — una máquina ASIC individual registrada en tu cuenta. Las suscripciones son por Equipo.
  • Firmware — el software operativo que ya corre en tu Equipo, sea el de fábrica o uno de terceros como Braiins OS+, LuxOS o VNish. HashOps no es firmware y no lo reemplaza.
  • Optimización de Red — enrutar el tráfico de minería de tu Equipo por el proxy Stratum gestionado de HashOps.
  • Optimización de Chip — instruir al Firmware existente de tu Equipo, a través de la propia interfaz de ese Firmware, para que mueva su objetivo de potencia.
  • Periodo de Suscripción — el plazo por el cual has pagado respecto de un Equipo determinado.

3. Qué es y qué no es el Servicio

HashOps es una capa de gestión, monitorización y optimización de flotas de equipos ASIC. Ofrece un panel de cuenta, recolección de telemetría, un proxy Stratum gestionado, módulos de optimización opcionales, bloqueo de equipos controlado por el dueño, y facturación de suscripciones.

El Servicio expresamente no es:

  • No es firmware. HashOps no reemplaza el software operativo de tu Equipo y no escribe en registros de voltaje ni de frecuencia. Cuando la Optimización de Chip está activada, HashOps envía solicitudes al Firmware que ya usas, mediante interfaces que ese Firmware publica, y ese Firmware decide cómo actuar sobre ellas.
  • No es un pool de minería. Tú eliges tu pool y tus pagos van directamente a ti. HashOps nunca recibe, retiene, enruta ni tiene derecho alguno sobre tus recompensas de minería.
  • No es una billetera, casa de cambio, custodio ni transmisor de dinero. Ver cláusula 12.
  • No es un servicio de inversión, financiero ni fiscal. Nada en el Servicio ni en su documentación constituye asesoría financiera.
  • No es un servicio de reparación, garantía ni seguro de tu hardware.

Los proveedores de firmware de terceros son independientes de HashOps. No estamos afiliados, respaldados ni actuamos como agentes de Braiins, Luxor, VNish ni de ningún fabricante de hardware. Sus nombres se usan únicamente para identificar compatibilidad. Tu relación con esos proveedores, incluidos sus propios términos de licencia y garantías, es exclusivamente tuya — ver cláusula 10.

4. Cuentas y seguridad

Eres responsable de la exactitud de tus datos de registro, de mantener tu contraseña en secreto, y de toda actividad que ocurra bajo tu cuenta.

Recomendamos encarecidamente activar la verificación en dos pasos, que el Servicio ofrece sin costo. Si la activas, eres responsable de guardar tus códigos de respaldo en un lugar seguro. Si pierdes tanto tu dispositivo de autenticación como tus códigos de respaldo, es posible que no podamos restaurar el acceso a tu cuenta.

Debes notificarnos sin demora a security@hashops.dev si crees que se ha accedido a tu cuenta sin autorización.

No puedes compartir, vender, alquilar ni transferir tus credenciales, ni permitir que otra persona use tu cuenta.

5. Licencia, no propiedad

Una suscripción compra acceso por un tiempo determinado. No compra el software, y no transfiere ninguna propiedad.

5.1 Lo que te concedemos

Sujeto a tu cumplimiento de estos Términos y al pago de las tarifas aplicables, te otorgamos una licencia limitada, no exclusiva, intransferible, no sublicenciable y revocable, únicamente durante el Periodo de Suscripción, para:

  • acceder y usar el Servicio para tus propias operaciones de minería, personales o internas de tu empresa; e
  • instalar y ejecutar una copia del Agente en cada Equipo cubierto por una suscripción pagada.

5.2 Lo que no te concedemos

Esta licencia no transfiere propiedad de ningún tipo. Todos los derechos no otorgados expresamente quedan reservados. En particular, no puedes:

  • copiar, modificar, adaptar, traducir ni crear obras derivadas del Servicio o del Agente, salvo cuando la ley lo imponga de forma que no pueda excluirse por contrato;
  • realizar ingeniería inversa, descompilar ni desensamblar ninguna parte del Servicio o del Agente, ni intentar derivar su código fuente, algoritmos o ideas subyacentes, salvo donde tal restricción sea inaplicable según la ley;
  • alquilar, arrendar, prestar, vender, sublicenciar, distribuir, hospedar ni poner el Servicio o el Agente a disposición de terceros, ni operarlo como servicio para terceros — salvo bajo un acuerdo escrito de reventa o marca blanca con nosotros;
  • eliminar, ocultar ni alterar avisos de propiedad, textos de licencia o atribuciones;
  • usar el Servicio para construir, entrenar o informar un producto competidor; ni
  • eludir o intentar eludir cualquier control de licenciamiento, medición, limitación de tasa o acceso.

5.3 La licencia termina cuando termina la suscripción

Cuando un Periodo de Suscripción vence o se termina, la licencia para ese Equipo finaliza de inmediato. El Agente deja de aplicar optimización y el Equipo vuelve a operar con su propio Firmware y configuración. Puedes desinstalar el Agente en cualquier momento (ver cláusula 9.4).

5.4 Planes "de por vida"

Un plan descrito como "de por vida" otorga una licencia por la vida útil del Equipo específico para el que fue comprado. Para ser claros sobre lo que eso significa y lo que no:

  • Está vinculado a un solo Equipo y no es transferible a una máquina distinta o de reemplazo.
  • Termina si ese Equipo se retira definitivamente, se destruye o se elimina de tu cuenta.
  • No puede sobrevivir al Servicio mismo. Si HashOps deja de operar el Servicio, la licencia termina con él. Ver cláusula 20.4 sobre qué ocurre en ese caso.

6. Propiedad intelectual

El Servicio, el Agente, el proxy de HashOps, el panel, todo el código fuente, diseños, interfaces y documentación asociados, el nombre y el logotipo de HashOps, y todas sus mejoras, son y seguirán siendo propiedad exclusiva de HashOps y sus licenciantes, protegidos por las leyes de derechos de autor y demás normas de propiedad intelectual.

Si nos envías comentarios, sugerencias o ideas sobre el Servicio, nos otorgas una licencia perpetua, mundial y libre de regalías para usarlos, sin obligación ni compensación hacia ti. No trataremos tus comentarios como información confidencial salvo que nos lo indiques por escrito de antemano y lo aceptemos.

Tus datos siguen siendo tuyos. La telemetría, configuración y datos de cuenta que generas a través del Servicio te pertenecen. La cláusula 14 explica qué hacemos con ellos.

El Servicio puede incluir componentes de código abierto de terceros, cada uno regido por su propia licencia. Esas licencias prevalecen sobre esta cláusula en caso de conflicto, y nada aquí restringe los derechos que te otorgan.

7. Planes, precios y pago

7.1 Cómo funciona el pago

Las suscripciones se pagan en USDC sobre la red Stellar. Al crear una factura, el Servicio emite un memo de pago único. Envías el monto exacto a la dirección indicada, incluyendo ese memo. El pago se identifica automáticamente, normalmente en menos de un minuto, y la suscripción se activa.

7.2 Tus responsabilidades al pagar

Los pagos en blockchain no pueden ser revertidos, ni por nosotros ni por nadie. Lee esta cláusula con atención.

  • Debes incluir el memo exacto. Un pago sin el memo correcto no puede asociarse automáticamente a tu cuenta.
  • Debes enviar el activo correcto (USDC) en la red correcta (Stellar) a la dirección correcta. Los fondos enviados como otro activo, en otra blockchain, o a otra dirección pueden perderse de forma permanente e irrecuperable. No tenemos visibilidad sobre otras redes ni capacidad de recuperar esas transferencias.
  • Debes enviar al menos el monto facturado. Los pagos incompletos no activan una suscripción.
  • Las comisiones de red corren por tu cuenta.

Si cometes un error al pagar, contáctanos en billing@hashops.dev. Haremos esfuerzos razonables por ayudarte cuando la transacción sea genuinamente identificable y recuperable, pero no podemos prometer recuperación y no somos responsables por pérdidas derivadas de una transferencia incorrecta.

7.3 Impuestos

Los precios no incluyen impuestos. Eres responsable de determinar y pagar cualquier impuesto, arancel o gravamen derivado de tu compra y de tu actividad de minería, y del tratamiento contable de los pagos en criptoactivos. El Servicio puede exportar registros de facturas incluyendo los hashes de transacción en cadena para tu contabilidad; esos registros expresan los montos en USDC y no los convierten a ninguna moneda fiat, porque la conversión correcta depende de tu jurisdicción y método contable.

7.4 Sin renovación automática

Las suscripciones no se renuevan automáticamente y no almacenamos datos de pago. Cada renovación es un pago nuevo y deliberado de tu parte. Si un Periodo de Suscripción termina sin renovación, el Equipo pasa a estado expirado según la cláusula 10.4.

7.5 Cambios de precio

Podemos cambiar los precios para compras futuras. Los cambios nunca afectan un Periodo de Suscripción que ya hayas pagado.

8. Reembolsos y cancelación

Puedes dejar de usar el Servicio cuando quieras. Dado que las suscripciones son pagos únicos, anticipados y no recurrentes, las tarifas generalmente no son reembolsables, y dejar de usar el Servicio no da derecho a reembolso del plazo restante.

Consideraremos un reembolso, a nuestro criterio, cuando el Servicio haya estado materialmente no disponible por un periodo prolongado por causa nuestra, o cuando se haya realizado un pago duplicado o claramente erróneo que sea identificable en cadena.

Nada en esta cláusula limita los derechos legales irrenunciables que puedas tener como consumidor según la ley de tu país de residencia, incluido cualquier derecho legal de desistimiento.

9. El software Agente

9.1 Qué requiere

El Agente requiere un Equipo con acceso a consola, Linux, Python 3 y systemd. No puede instalarse en firmware de fábrica bloqueado que no ofrezca acceso a consola; en esos Equipos el instalador se detiene con un mensaje claro en lugar de instalarse parcialmente.

9.2 Qué hace

  • Lee telemetría de la interfaz local de minería de tu Equipo (hashrate, temperaturas, velocidad de ventiladores, shares aceptadas y rechazadas, y conteo de chips por placa cuando el Firmware lo reporta).
  • Envía esa telemetría a tu cuenta de HashOps por una conexión autenticada.
  • Aplica únicamente los estados y ajustes que tú hayas autorizado desde tu panel.
  • Respalda tu configuración de minería original antes de modificarla, para que el cambio pueda deshacerse.

9.3 Qué no hace

El Agente no flashea ni modifica imágenes de firmware. No escribe en registros de voltaje ni de frecuencia. No contiene borrado remoto, ni código que se autoelimine, ni capacidad alguna de dejar un Equipo permanentemente inutilizable. Todo estado que puede aplicar es reversible.

9.4 Cómo quitarlo

Puedes desinstalarlo cuando quieras eligiendo "Revertir" en el panel, lo que restaura tu configuración respaldada y desactiva el servicio del Agente, o quitándolo manualmente del Equipo. Ninguna de las dos vías requiere nuestro permiso ni nuestra colaboración.

9.5 Tu responsabilidad

Confirmas que eres dueño de los Equipos que registras, o que cuentas con autorización del dueño para instalar software en ellos y cambiar sus ajustes operativos. Eres responsable del entorno físico donde operan tus Equipos, incluidas calidad eléctrica, refrigeración, ventilación y temperatura ambiente.

10. Módulos de optimización

El Servicio ofrece dos módulos independientes por Equipo. Cada uno es una elección separada y puede encenderse o apagarse en cualquier momento.

10.1 Optimización de Red

Enruta el tráfico de minería de tu Equipo por nuestro proxy Stratum gestionado para reducir latencia y shares obsoletas o rechazadas. No altera cómo opera tu hardware. Está disponible en todo Firmware, incluido el de fábrica bloqueado.

Sigues eligiendo tu propio pool. No cambiamos tu dirección de pago y no tenemos acceso a tus recompensas de minería. Si nuestro proxy deja de estar disponible, tu Equipo queda configurado para seguir minando hacia el pool que elegiste.

10.2 Optimización de Chip

Este módulo viene apagado por defecto. Nada cambia en el funcionamiento de tu hardware salvo que tú lo actives deliberadamente, Equipo por Equipo.

Al activarlo, HashOps calcula un objetivo de potencia según el objetivo que elijas — Longevidad (por defecto; deliberadamente por debajo del nominal para reducir estrés térmico y eléctrico), Eficiencia (mejor energía por terahash), o Económico (mayor ganancia según el precio de electricidad y el pago por TH que tú proporciones) — y le pide al Firmware existente de tu Equipo que se mueva hacia él, usando la interfaz publicada de ese Firmware.

Las siguientes salvaguardas están incorporadas y operan automáticamente:

  • Los objetivos solicitados se limitan al mínimo y máximo que el propio Firmware declara.
  • Los cambios se aplican en pasos de no más del 10% del objetivo actual.
  • No más de un cambio por hora, para que el tuner del propio Firmware pueda estabilizarse.
  • La potencia se reduce automáticamente si la temperatura supera el límite que fijaste, y se reduce más por encima de 85 °C.
  • Existe un techo de 80 °C que ningún ajuste tuyo puede elevar.
  • El valor por defecto del Firmware se restaura automáticamente si el hashrate cae significativamente tras un cambio.
  • A un Equipo cuyo Firmware no haya reportado capacidad de ajuste nunca se le envía una instrucción.

10.3 Riesgos que aceptas al activar la Optimización de Chip

Pese a esas salvaguardas, reconoces y aceptas que:

  • El hardware de minería opera bajo estrés térmico y eléctrico continuo y puede fallar en cualquier momento, con o sin HashOps. Los componentes se degradan con el uso.
  • No controlamos tu Firmware. Él decide cómo actuar ante un objetivo solicitado, y su comportamiento, precisión y límites de seguridad son responsabilidad del proveedor, no nuestra.
  • No controlamos la temperatura ambiente, el flujo de aire, la calidad del suministro eléctrico, la estabilidad de la red, ni el estado o desgaste previo de tu hardware.
  • Cambiar parámetros de operación mediante una interfaz externa puede afectar la garantía de tu hardware o los términos de tu proveedor de firmware. Verificarlo antes de activar este módulo es tu responsabilidad.
  • Ningún objetivo, incluido "Longevidad", garantiza una vida útil extendida, y ningún objetivo, incluido "Económico", garantiza ni proyecta ganancias.

Si no estás dispuesto a aceptar estos riesgos, deja la Optimización de Chip apagada. La Optimización de Red, la telemetría, las alertas y el bloqueo antirrobo siguen plenamente disponibles.

10.4 Vencimiento

Si una suscripción vence, el Equipo pasa a estado expirado: la optimización se detiene y el Equipo vuelve a su propia configuración y sigue minando directamente hacia tu pool. Una suscripción vencida nunca bloquea, desactiva ni detiene un Equipo. Al renovar se restablece el servicio.

11. Bloqueo del equipo — una herramienta antirrobo que tú controlas

HashOps no puede bloquear tu hardware. Solo tú puedes, y solo tú puedes desbloquearlo. Nunca usaremos el bloqueo como presión para cobrar.

El Servicio incluye una función opcional de bloqueo para que, si un Equipo es robado o alguien accede físicamente a él sin tu permiso, puedas dejarlo inservible para quien lo tenga. Funciona como el bloqueo remoto de un teléfono o una laptop.

  • El bloqueo y el desbloqueo se activan únicamente desde tu propia sesión autenticada en el panel, sobre un Equipo registrado en tu cuenta. El sistema verifica la titularidad en cada solicitud.
  • HashOps no inicia bloqueos. No existe mecanismo alguno en el Servicio mediante el cual bloqueemos el Equipo de un cliente, y la falta de pago conduce al estado expirado descrito en la cláusula 10.4 — nunca a un bloqueo.
  • Puedes desbloquear cuando quieras desde tu panel, o con un código de rescate que tú mismo generas, que funciona directamente contra el Equipo incluso sin conexión con nosotros.
  • El bloqueo detiene el servicio de minería e intercambia un archivo de configuración. Es totalmente reversible y no causa ningún cambio permanente en el hardware.

Solo debes bloquear Equipos de los que seas dueño o que estés autorizado a controlar. Usar esta función contra hardware ajeno puede ser ilegal y constituye un incumplimiento grave de estos Términos.

12. Nunca manejamos tu dinero

HashOps no es custodio. Recibimos pagos únicos por un servicio, exactamente como una tienda recibe el pago de una venta.

  • No existe billetera de usuario, ni saldo almacenado, ni función de retiro en el Servicio.
  • Nunca retenemos, transmitimos, intercambiamos ni controlamos criptoactivos por tu cuenta.
  • Tus recompensas de minería van directamente desde tu pool a una dirección que tú controlas. Nunca las tocamos, no podemos redirigirlas y no tenemos derecho alguno sobre ellas.
  • No podemos mover fondos "en tu nombre" a ningún sitio, porque esa capacidad no existe en el sistema.

Eres el único responsable de la seguridad de tus billeteras, llaves y configuración de pagos del pool.

13. Uso aceptable

Aceptas no:

  • usar el Servicio con fines ilícitos, ni en infracción de sanciones, controles de exportación o normas contra el lavado de dinero que te sean aplicables;
  • registrar o controlar Equipos que no sean tuyos y que no estés autorizado a gestionar;
  • usar hardware de minería o electricidad obtenidos ilícitamente, ni operar incumpliendo un acuerdo con un arrendador, proveedor de hosting o compañía eléctrica;
  • intentar obtener acceso no autorizado al Servicio, a cuentas o datos de otros clientes, o a nuestra infraestructura;
  • sondear, escanear, hacer pruebas de penetración, sobrecargar o interferir con el Servicio sin nuestro permiso previo por escrito;
  • introducir software malicioso, ni usar el Servicio para atacar a terceros;
  • eludir límites de tasa o controles de uso, ni acceder al Servicio por medios automatizados distintos de las interfaces que proporcionamos; ni
  • falsear tu identidad o afiliación.

Eres responsable de cumplir todas las leyes aplicables a la minería de criptomonedas donde operes, incluidas obligaciones de registro, energéticas, ambientales, fiscales y de reporte.

14. Datos y privacidad

14.1 Qué recopilamos

  • Datos de cuenta — nombre de usuario, correo electrónico opcional, contraseña cifrada (hash), y (si la activas) secretos de verificación en dos pasos y códigos de respaldo cifrados.
  • Datos de equipo — nombres e identificadores que elijas, y telemetría: hashrate, temperaturas, velocidad de ventiladores, consumo, shares aceptadas y rechazadas, y conteo de chips por placa cuando se reporte.
  • Datos operativos — la configuración que fijas, las decisiones de ajuste y sus motivos, registros de facturas y referencias de transacciones en cadena, y eventos de seguridad como intentos fallidos de inicio de sesión y usos de códigos de rescate (incluida la dirección IP de origen).

No recopilamos las llaves privadas de tu billetera, tus credenciales del pool ni tus direcciones de pago, porque el Servicio no las necesita ni tiene campo donde almacenarlas.

14.2 Cómo los usamos

Para operar, asegurar y dar soporte al Servicio; calcular decisiones de optimización; detectar fallos y enviarte alertas; procesar suscripciones; y cumplir obligaciones legales. No vendemos tus datos.

14.3 Con quién los compartimos

Solo con proveedores de infraestructura estrictamente necesarios para operar el Servicio (hospedaje, protección de red y envío de correo cuando hayas activado notificaciones por email), y cuando lo exija un proceso legal válido. Los datos de pagos en blockchain son públicos por naturaleza en la red Stellar; eso es una propiedad de la red, no una divulgación nuestra.

14.4 Conservación

Los registros de cuenta y facturación se conservan mientras tu cuenta esté activa y después durante el tiempo necesario para fines legales, fiscales y contables. La telemetría se conserva para análisis operativo y de tendencias. Puedes solicitar la eliminación de tu cuenta y datos personales asociados escribiendo a privacy@hashops.dev; lo cumpliremos salvo los registros que estemos legalmente obligados a conservar.

14.5 Tus derechos

Según dónde residas, puedes tener derecho a acceder, corregir, exportar, restringir o eliminar tus datos personales, y a oponerte a ciertos tratamientos. Escribe a privacy@hashops.dev para ejercerlos.

14.6 Seguridad

Aplicamos medidas que incluyen cifrado de contraseñas, verificación en dos pasos opcional, transporte cifrado, sesiones revocables del lado del servidor, límites y bloqueo por intentos de inicio de sesión, y registro de auditoría de acciones sensibles. Ningún sistema es perfectamente seguro, y no podemos garantizar que nunca ocurra un acceso no autorizado.

15. Funciones beta y preliminares

Podemos poner a disposición funciones marcadas como beta, alfa, vista previa o experimentales. Se proporcionan tal cual, sin garantía alguna, pueden ser inestables o incompletas, pueden cambiar o retirarse en cualquier momento sin aviso, y quedan excluidas de cualquier compromiso de disponibilidad. No dependas de una función beta para una operación crítica. El acceso a funciones beta se concede a nuestro criterio y puede revocarse en cualquier momento.

16. Disponibilidad y soporte

Procuramos mantener el Servicio disponible de forma continua, pero no nos comprometemos a un nivel específico de disponibilidad ni ofrecemos acuerdo de nivel de servicio (SLA), salvo que hayamos firmado contigo un acuerdo escrito aparte que diga otra cosa.

El Servicio puede no estar disponible durante mantenimientos, o por fallos de infraestructura, redes o proveedores externos fuera de nuestro control.

El soporte se presta con base en mejores esfuerzos a través de hello@hashops.dev en horario laboral razonable. Actualmente no ofrecemos soporte 24/7. El Servicio incluye alertas automáticas que te notifican equipos desconectados, temperaturas excesivas y fallos de placas sin intervención humana; esas alertas son observaciones y no constituyen un compromiso de que alguien esté respondiendo a ellas.

17. Exenciones de garantía

En la máxima medida permitida por la ley aplicable, el Servicio y el Agente se proporcionan "tal cual" y "según disponibilidad", y rechazamos toda garantía, expresa, implícita o legal, incluidas las garantías implícitas de comerciabilidad, idoneidad para un fin determinado, titularidad y no infracción.

Sin limitar lo anterior, no garantizamos que:

  • el uso del Servicio aumente tu hashrate, eficiencia, ingresos o ganancias;
  • ningún objetivo, incluido "Longevidad", prolongue la vida de ningún hardware;
  • el Servicio sea ininterrumpido, puntual, libre de errores o de componentes dañinos;
  • la telemetría, cálculos, recomendaciones o informes sean exactos o completos; ni
  • los defectos vayan a corregirse.

La rentabilidad de la minería depende de la dificultad de red, los precios de los activos, el desempeño del pool, el costo de la electricidad y el estado del hardware — todo fuera de nuestro control. Cualquier cifra, proyección, objetivo de optimización o métrica de piloto que presente el Servicio es una estimación basada en los datos de que dispone, incluidos los que tú proporcionas, y no es promesa de resultado alguno.

Algunas jurisdicciones no permiten excluir ciertas garantías. En esos lugares, las exclusiones anteriores aplican solo en la medida permitida, y puedes tener derechos que estos Términos no pueden eliminar.

18. Limitación de responsabilidad

En la máxima medida permitida por la ley aplicable:

  • no somos responsables por daños indirectos, incidentales, especiales, consecuentes, ejemplares o punitivos, ni por lucro cesante, pérdida de ingresos de minería, pérdida de oportunidad, pérdida de datos o interrupción del negocio, cualquiera que sea su causa y bajo cualquier teoría de responsabilidad, aun habiendo sido advertidos de su posibilidad;
  • nuestra responsabilidad total agregada derivada de estos Términos o del Servicio, por todas las reclamaciones en conjunto, no excederá el monto total que efectivamente nos hayas pagado por el Equipo afectado en los doce (12) meses previos al hecho que origine la reclamación, o 100 USDC, lo que sea mayor.

Estos límites aplican en la máxima medida permitida por la ley. Nada en estos Términos excluye ni limita nuestra responsabilidad por dolo, declaraciones fraudulentas, muerte o lesiones personales causadas por nuestra negligencia, ni cualquier otra responsabilidad que no pueda excluirse legalmente — incluidos los derechos irrenunciables del consumidor en tu jurisdicción.

Reconoces que el precio del Servicio refleja esta distribución del riesgo, y que no prestaríamos el Servicio en estos términos sin ella.

19. Indemnización

Aceptas indemnizar y mantener indemne a HashOps, sus directivos, empleados y contratistas frente a cualquier reclamación, demanda, pérdida, responsabilidad o gasto (incluidos honorarios legales razonables) derivados de: tu uso del Servicio; tu incumplimiento de estos Términos; tu violación de cualquier ley; tu operación de hardware de minería; o cualquier reclamación de que registraste, bloqueaste, modificaste o controlaste un Equipo que no estabas autorizado a controlar.

20. Suspensión y terminación

20.1 Por tu parte

Puedes dejar de usar el Servicio y quitar el Agente cuando quieras, sin necesitar nuestra intervención. Escribe a hello@hashops.dev para cerrar tu cuenta.

20.2 Por nuestra parte

Podemos suspender o terminar tu acceso, con aviso cuando sea razonablemente posible, si incumples materialmente estos Términos, si tu uso amenaza la seguridad, integridad u operación lícita del Servicio o de otros clientes, o si la ley lo exige.

20.3 Efectos

Al terminar, tu licencia finaliza y el Agente deja de aplicar optimización. La terminación nunca bloquea tu hardware. Tus Equipos siguen operando con su propio Firmware y configuración, minando hacia el pool que elegiste. Puedes retirar el Agente tú mismo. Las cláusulas que por su naturaleza deban subsistir — incluidas la 6, 12, 17, 18, 19 y 22 — subsisten tras la terminación.

20.4 Si discontinuamos el Servicio

Si decidimos discontinuar el Servicio por completo, daremos al menos sesenta (60) días de aviso al correo registrado en tu cuenta cuando lo hayas proporcionado, y mediante el panel. Durante ese periodo podrás exportar tus datos. Ofreceremos un reembolso prorrateado de la parte no utilizada de las suscripciones de plazo fijo. Para los planes "de por vida", ofreceremos un reembolso calculado sobre una base justa y razonable atendiendo al tiempo ya transcurrido, que publicaremos junto con el aviso de discontinuación. En todos los casos, los Equipos siguen minando con su propio Firmware una vez terminado el Servicio.

21. Cambios a estos términos

Podemos actualizar estos Términos. Para cambios materiales daremos al menos treinta (30) días de aviso por correo cuando hayas proporcionado una dirección, y mediante aviso en el panel, antes de que entren en vigor. Seguir usando el Servicio después de esa fecha significa que aceptas los Términos revisados. Si no los aceptas, deja de usar el Servicio antes de la fecha de entrada en vigor; cuando un cambio material te perjudique genuinamente, puedes solicitar un reembolso prorrateado de la parte no utilizada de tu suscripción de plazo fijo vigente.

Cada versión lleva fecha, y la versión vigente siempre se publica en esta página.

22. Ley aplicable y controversias

Estos Términos se rigen por las leyes de la jurisdicción en la que HashOps está establecido, sin atender a sus normas de conflicto de leyes, y excluyendo la Convención de las Naciones Unidas sobre los Contratos de Compraventa Internacional de Mercaderías. Los tribunales competentes de esa jurisdicción tienen jurisdicción exclusiva, salvo que si eres consumidor, conservas la protección de las normas imperativas y el derecho a demandar ante los tribunales de tu país de residencia cuando la ley local te otorgue ese derecho.

Antes de iniciar acciones formales, te pedimos que nos contactes para intentar resolver el asunto directamente. La mayoría de los casos se resuelven así.

Si alguna disposición de estos Términos resultara inaplicable, se limitará o suprimirá en la mínima medida necesaria, y las demás disposiciones seguirán en pleno vigor. Que no hagamos valer una disposición no supone su renuncia. Estos Términos, junto con los documentos que referencian, constituyen el acuerdo completo entre nosotros respecto del Servicio. No puedes ceder estos Términos sin nuestro consentimiento escrito; nosotros podemos cederlos a un sucesor en el marco de una fusión, adquisición o venta de activos, notificándotelo.
